(‘Poll’d,’ ‘we,’ ‘us,’ or ‘our’) collects, uses, discloses, and safeguards information when you visit getpolld.com or use our platform to create and distribute polls. 1.3 Information Collected from Poll Respondents

When individuals respond to a Poll’d poll, we may collect:

  • Their poll responses

  • IP address and approximate location (for fraud prevention)

  • Timestamp of submission

Poll respondents’ data is collected on behalf of the Poll’d customer (the poll creator) and is governed by their privacy practices, in addition to this policy.

 

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Poll’d platform

  • Send campaigns and collect poll responses on your behalf

  • Process transactions and send purchase confirmations and invoices

  • Send administrative communications such as updates, security alerts, and support messages

  • Analyze usage trends to improve user experience and platform performance

  • Detect and prevent fraudulent, abusive, or unauthorized activity

  • Comply with applicable legal obligations

  • Send marketing and promotional communications (you may opt out at any time)

 

3. What We Don’t Do

We are committed to responsible data practices. Specifically:

  • We do not sell your personal data to third parties

  • We do not share recipient lists between accounts

  • We do not send marketing emails to your recipients

  • We do not use your data to train AI models

 

4. How We Share Your Information

4.2 Poll’d Customers and Respondents

If you are a poll respondent, your responses will be shared with the Poll’d customer who created the poll. If you are a Poll’d customer, we may share your poll data with collaborators you authorize within your account.

4.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).

4.4 Business Transfers

If Poll’d is acquired, merged, or undergoes a change in ownership, your information may be transferred as part of that transaction. We will notify you in advance of any such change and the choices available to you.

 

5. Cookies and Tracking Technologies

We use essential cookies to keep you signed in and remember your preferences. We do not use advertising or third-party tracking cookies. You can control cookie preferences through your browser settings, though disabling essential cookies may impact platform functionality.

 

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes, and enforce our agreements. When you close your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain it for legal or regulatory purposes.

9. Recipients & Unsubscribing

If you received a poll from a Poll’d user and want to stop receiving emails, you can unsubscribe using the link in any email we send on their behalf. Your request will be honored immediately. We do not send unsolicited marketing emails to poll recipients.

 

10. Children’s Privacy

Poll’d is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe we may have collected information from a child, please contact us at hello@getpolld.com.

 

11. International Data Transfers

Poll’d is operated in the United States. If you are accessing our platform from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. For users in the EEA or United Kingdom, we rely on appropriate legal transfer mechanisms, including Standard Contractual Clauses.

 

12. California Privacy Rights

If you are a California resident, you have additional rights under the CCPA, including the right to know what personal information we collect, the right to delete it, and the right to opt out of its sale (we do not sell personal information). Terms of Service

1. Agreement to Terms

By creating an account or using Get Poll’d, you agree to these terms. If you don’t agree, please don’t use the service. We may update these terms from time to time — continued use after changes means you accept the updated terms.

 

2. What Get Poll’d Provides

Get Poll’d is a platform that lets you create and send email micro-polls to your recipients. We handle the delivery, response collection, and reporting so you can gather feedback quickly and easily.

 

3. Your Account

When creating and maintaining your account, you agree that:

  • You must provide accurate information when creating an account

  • You are responsible for keeping your login credentials secure

  • You are responsible for all activity that occurs under your account

  • You must be at least 18 years old to use Get Poll’d

 

4. Acceptable Use

You agree to use Get Poll’d lawfully and responsibly. You must not:

  • Send spam or unsolicited bulk emails

  • Upload recipient lists without proper consent

  • Use the service for phishing, fraud, or deceptive purposes

  • Send content that is illegal, harmful, or harassing

  • Attempt to access other users’ accounts or data

  • Interfere with or disrupt the platform’s operation

  • Resell or redistribute the service without permission

 

5. Your Content

You own the content you create on Get Poll’d (polls, campaigns, templates). By using the service, you grant us a limited license to store, process, and transmit your content solely to operate the platform on your behalf. We won’t use your content for any other purpose.

 

6. Recipient Consent

You are responsible for ensuring that you have the necessary consent or legitimate basis to email the recipients in your campaigns. Get Poll’d provides the tools — you are responsible for using them in compliance with applicable laws, such as CAN-SPAM, GDPR, or CASL.

 

7. Service Availability

We strive to keep Get Poll’d available and reliable, but we don’t guarantee 100% uptime. We may occasionally need to perform maintenance, updates, or experience unexpected outages. We’ll do our best to notify you of any planned downtime.

 

8. Account Suspension & Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive behavior, or use the service in a way that harms other users or the platform. You can also delete your account at any time through your account settings.

 

9. Limitation of Liability

Get Poll’d is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

 

10. Intellectual Property

The Get Poll’d name, logo, and platform are owned by us. These terms don’t grant you any rights to our branding or intellectual property beyond what’s needed to use the service.

 

11. Governing Law

These terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable federal and state law.

Accessibility Statement
